Professional Experience

Mr. Macke’s expertise in defending claims under the United States Constitution and his broad areas of practice exemplify the varied aptitudes at Robles, Rael & Anaya. Mr. Macke specializes in the defense of government agencies and public officials primarily in the areas of employment, law enforcement, First Amendment free speech, civil rights, election law,  contracts, personal injury and real property. Additionally, Mr. Macke’s practice  includes construction defect litigation, land use, administrative law and public school law. Mr. Macke’s extensive  litigation experience includes the litigation of cases before the New Mexico State and Federal District Courts, the Human Rights Commission, the State Personnel Board, as well as state and federal appellate courts.

Mr. Macke has successfully defended claims arising under the U.S. Constitution, including Fourth and Fourteenth Amendment claims of excessive force; First Amendment free speech, Fourteenth Amendment Procedural and Substantive Due Process; Eighth and Fourteenth Amendment Due Process claims arising from inmates’ claims of administrative segregation, isolation and lockdown, loss of inmate privileges, cruel and unusual punishment, and the alleged delay or failure to provide medical care; and statutory claims arising under state and federal law, including the New Mexico Tort Claims Act, the American with Disabilities Act, Title VII, and the Rehabilitation Act.
